These Terms of Service (“Terms”) govern your access to and use of thed:spatch software, website, and hosted services (collectively, the “Service”) operated by d:spatch (“we”, “us”, or “our”). By downloading, installing, or using d:spatch in any capacity, you agree to be bound by these Terms. If you do not agree, do not use the Service.
d:spatch is an open-source platform for deploying and orchestrating autonomous AI agents in sandboxed Docker environments. The Service consists of:
You must be at least 18 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.
The d:spatch open-source components are provided under their respective licenses as published in the source repositories at github.com/dspatch. Your use of the open-source software is governed by those license terms, which take precedence over these Terms with respect to the software itself. These Terms apply to your use of the website, the hosted services, and any commercial or SaaS features.
Access to the hosted relay service requires an account. You agree to:

You retain full ownership of all content, data, code, and files you create, process, or transmit through d:spatch. We claim no intellectual property rights over your content. Because the hosted relay operates on end-to-end encrypted data, we are technically unable to access, read, or disclose your content.
You grant us only the limited technical permissions necessary to operate the relay service — specifically, to transmit and temporarily cache your encrypted data for delivery to your authorized devices.
d:spatch is designed to integrate with third-party AI providers and tools (such as Anthropic's Claude API). Your use of those services is governed by their own terms and policies. We are not responsible for the behavior, availability, or outputs of third-party AI models or APIs. You are solely responsible for your API key usage and any costs incurred.
The d:spatch name, logo, website design, and non-open-source elements of the Service are our intellectual property. You may not use our trademarks, logos, or brand assets without prior written permission. Nothing in these Terms transfers any intellectual property rights to you except as explicitly stated.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Given the experimental nature of autonomous AI agents, you acknowledge that agent outputs may be incorrect, incomplete, or unexpected, and you are solely responsible for reviewing and validating any agent-generated work before relying on it.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL D:SPATCH, ITS CONTRIBUTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless d:spatch and its contributors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content or agents you deploy through the platform.
We reserve the right to suspend or terminate your access to the hosted relay service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. You may terminate your account at any time by contacting us at [email protected]. Termination does not affect your right to continue using the open-source software under its applicable license.
We may update these Terms as the Service evolves. When we make material changes, we will update the “Last updated” date above and, if you have an account, notify you via the email address associated with your account. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
If you are a consumer within the European Union and have entered into a contract for the hosted relay service, you have the right to withdraw from the contract within 14 days without giving any reason (§ 355 BGB, Art. 9 Directive 2011/83/EU). To exercise this right, contact us at [email protected] with a clear statement of your decision. Upon withdrawal, we will reimburse all payments received from you within 14 days.
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer within the EU, you additionally benefit from any mandatory provisions of the law of your country of residence.
